OpenAgriSynapse Terms of Service
Rights, obligations, and responsibilities regarding use of the OAS platform
Article 1 (Purpose)
These Terms are intended to define the rights, obligations, and responsibilities between OAS and its members, as well as other necessary matters, regarding the use of the agricultural data simulation platform and related services (hereinafter "Services") provided by OpenAgriSynapse (hereinafter "OAS").
Article 2 (Simulation Engine and License Notice)
The OAS service is a platform that integrates and provides the proprietary OAS Native Engine and various open-source-based simulation modules.
Some features of the current service are based on or provide compatibility with the DSSAT-CSM-OS model from the DSSAT Foundation.
OAS is not affiliated with the DSSAT Foundation or University of Florida, and this service is not endorsed or officially approved by those organizations.
The use of open-source software (DSSAT, etc.) within the service complies with each respective license (e.g., BSD 3-Clause License), and the relevant license notices are provided through the [Addendum] of these Terms or a separate page on the website.
Article 3 (Copyright and Responsibility for Member Posts and Data)
- The copyright of files, data, documents, etc. (hereinafter "User Data") uploaded by members for service use belongs to the members themselves.
- Members must hold legitimate copyright or have legitimate licenses and authority to use the "User Data" they upload.
- All legal issues (including civil and criminal liability) arising from "User Data" uploaded by members infringing on the copyright, intellectual property rights, or other rights of third parties are entirely the responsibility of the member. OAS assumes no legal responsibility in this regard.
- If a third party submits a copyright infringement or rights infringement claim regarding "User Data," OAS may take reasonable and best-effort measures such as suspension of posting or deletion of the relevant data in accordance with applicable laws.
Article 4 (Rights Attribution of Simulation Results)
- Results derived from analyzing, processing, and computing "User Data" through OAS simulation engines (OAS Native Engine or integrated external modules) — including reports, graphs, predicted values, analysis data, etc. (hereinafter "Secondary Outputs") — constitute derivative works created with the investment of OAS's proprietary data processing technology and algorithms.
- Due to the nature of the service, copyright and other intellectual property rights to the derived "Secondary Outputs" belong to OAS.
- Members have the right to ordinary use of "Secondary Outputs" generated through the use of this service within the scope of their own research, farming activities, or other non-commercial purposes or ranges separately permitted by OAS.
Article 5 (Obligations for Data Retention and Provision)
- OAS uses "User Data" uploaded by members within the scope of simulation execution purposes.
- OAS is not a "User Data" storage (Cloud Storage) service, and unless a contract for explicit features such as paid services has been concluded, OAS has no obligation to permanently store, organize, back up, or re-provide uploaded materials for members.
- Members must separately store their data on their own storage media, and OAS is not responsible for damages due to data loss or deletion.
Article 6 (Definitions)
The definitions of terms used in these Terms are as follows.
- "Member" refers to a customer who accesses OAS, agrees to these Terms, enters into a service agreement, and uses the services provided by OAS.
- "ID" refers to a combination of letters and numbers (such as email addresses) determined by the member and approved by OAS for member identification and service use.
- "Password" refers to a combination of letters or numbers set by the member to confirm identity matching with the assigned "ID" and for confidentiality protection.
- "Paid Services" refers to various paid services provided by OAS, including digital content, feature enhancements, API call limit increases, etc.
Article 7 (Conclusion of Service Agreement)
- A service agreement is concluded when a person wishing to become a member (hereinafter "Applicant") agrees to the terms of these Terms, submits a membership application, and OAS approves such application.
- In principle, OAS approves applicants' membership applications. However, OAS may refuse approval or later terminate the service agreement if the applicant uses a false name, uses another person's identity, or provides false information.
Article 8 (Member Obligations)
- Members must comply with applicable laws, these Terms, usage guidelines, notices related to the service, and matters notified by OAS, and must not engage in any actions that interfere with OAS's operations.
-
Members must not engage in the following:
- A. Registration of false information during application or modification
- B. Misappropriation of others' information
- C. Alteration of information posted by OAS
- D. Transmission or posting of information other than what OAS has designated (computer programs, etc.)
- E. Infringement of OAS's and other third parties' copyright and intellectual property rights
- F. Actions that damage the reputation of OAS and other third parties or interfere with operations
- G. Using information obtained through the service for reproduction, distribution, or commercial use without OAS's prior consent
- H. Attempting reverse engineering or source code extraction of the simulation engine
Article 9 (Provision and Modification of Services)
- In principle, the service is provided 24 hours a day, 365 days a year.
- OAS may temporarily suspend the provision of services due to maintenance, replacement, and failure of information and communication equipment, communication disruption, or other significant operational reasons.
- OAS may modify all or part of the services being provided for significant reasons such as service feature enhancements or changes in operational policies.
Article 10 (Contract Termination and Restrictions on Use)
- Members may apply for termination of the service agreement at any time through the information management menu within the service, and OAS shall process this immediately in accordance with applicable laws.
- When a member terminates the contract, posts and uploaded data may be deleted. However, "Secondary Outputs" generated pursuant to Article 4 may be retained in anonymized form in OAS's database.
- If a member violates their obligations under these Terms or disrupts the normal operation of the service, OAS may restrict service use in stages, including warning, temporary suspension, and permanent suspension.
Article 11 (Damages and Liability)
- OAS is not liable for any damages related to the use of free services unless otherwise specifically provided by applicable law.
- Simulation results and predictive data provided by OAS are merely estimates based on scientific models and do not guarantee consistency with actual agricultural field results. Members should use simulation results as reference materials, and the responsibility for farming decisions and investments based on them lies with the member.
- OAS is exempt from liability for the provision of services in cases where the service cannot be provided due to force majeure events or equivalent circumstances.
- OAS is not responsible for any service usage disruptions caused by the member's own fault.
Article 12 (Governing Law and Jurisdiction)
- Lawsuits filed between OAS and members shall be governed by the laws of the Republic of Korea.
- Disputes between OAS and members shall be filed with the competent court under the Civil Procedure Act.
[Addendum]
Article 1 (Effective Date)
These Terms shall take effect from February 1, 2026.
